Kentucky Revisiting Licensing of Non-Registered Pharmacist

 

Kentucky Board of Pharmacy posted in the May 1, 2024, Administrative Register (register page 2284) , numerous proposed amendments to the Practice of Pharmacy. Most notable is that KY BOP is revisiting proposed licensing of Non-Registered Pharmacist that was withdrawn in 2023. This includes 201 KAR 2:030 amending the license transfer requirements and adds the new non-resident pharmacist license. A non-resident pharmacist that dispenses prescriptions to a Kentucky citizen must hold a Kentucky Non-resident pharmacist license. The pharmacist must hold an active license in good standing from another state, is issued a NABP Verify credential and submits to a fingerprint check. The pharmacist will be exempt from the requirements for licensure transfer, jurisprudence exam and continuing education.

 

Other proposed changes include:

  • Adds a new administrative regulation, 201 KAR 2:465, creating a new non-resident pharmacy application and waiver regulation (register page 2330) which establishes the requirements to obtain a Non-Resident Pharmacy permit to engage in the practice of pharmacy servicing Kentucky citizens. The overview of requirements are resident state inspections, sops for shipping and delivery, and that the PIC answers the toll-free telephone service 6 days a week and a minimum of 40 hours per week. If PIC unavailable a staff pharmacist may answer the call, but the staff pharmacist must notify the PIC of the call with a callback number to the patient. The PIC shall return the call to the patient within 48 hours.
  • Amends 201 KAR 2:050. Licenses and permits; fees by adding $50 fee for Initial Non-Pharmacist Application, Renewal Non-Pharmacist Application and Delinquent Renewal penalty (register page 2287).
  • Amends 201 KAR 2:015. Continuing education by changing the time frame when the 15 contact hours must be obtained from January 1st to December 31st to  now being obtained from March 31st to February 28th (register page 2282).
